TERMS AND CONDITIONS

WAIVER AND RELEASE OF CLAIMS AND LIABILITY

I hereby expressly and affirmatively state that I wish to participate in Run Better Academy’s coaching product.  I realize that my participation in the activities offered by Run Better Academy LLC, including but not limited to running, strength training, nutrition, cross training, exercises, coaching, and advice, is voluntary and involve the risk of injury, including, but not limited to, musculoskeletal injuries, overuse injuries, sprains, strains, fatigue, heart attack and even the possibility of death.  I recognize that may other injuries, including serious disabling injuries, may arise due to my participation in these activities and that it is not possible to specifically list all individual injury risks.   I further recognize participation in these activities can involve property loss.  I certify that I am in good health, physically fit, and cleared by a licensed physician to enter into a training program.  Knowing the material risks and appreciating, knowing, and reasonably anticipating that loss, injuries and even death are a possibility, I hereby expressly assume all of the risk of injury, all other possible risk of injury, even death, and all other loss which could occur by reason of my participation.

By participating in this activity, I release and promise not to sue Run Better Academy LLC and the officers, directors, coaches, representatives, employees, employers, sponsors, predecessors, successors, assigns, agents, insurers, affiliates, attorneys, and all other persons and entities of Run Better Academy, LLC (hereafter “Released Parties”) from any and all present and future claims of any loss, damage, personal injury, or death resulting from my using the services and content of the Released Parties.  My release and promise not to sue as described above applies both to known and unknown claims that may be made by me and to known and unknown claims that may be made by my family, my estate, my heirs, my representatives, my insurers, and my assigns.

I also agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation in these activities with the Released Parties.

I understand that this Waiver and Release of Claims and Liability is intended to be as broad and inclusive as permitted by the laws and state of Delaware and I agree that if any portion is held invalid, the remainder of the Waiver and Release of Claims and Liability will continue in full legal force and effect.

I have been given the opportunity to ask questions. Any questions I have asked have been answered to my complete satisfaction. I understand the risks of my participation in these activities, and knowing and appreciating these risks I voluntarily choose to participate assuming the risks of loss, injury or even death due to my participation.
